Terms of Service
Last updated:
[Operator details pending] until completed in lib/legal/config.ts.These Terms of Service (“Terms”) govern your access to and use of ReqBrief(“the Service”), operated by [Operator name pending](“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
You accept these Terms by signing up for an account, by sending an interview link to a client, or by responding to an interview. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. What the service does
ReqBrief is an AI-assisted requirement-gathering tool. It generates interview links you send to your clients, conducts a structured interview using a large language model, and produces a structured project brief from the resulting transcript. The Service is currently in early access and may change, expand, or be withdrawn without notice.
3. Your account
- You must provide a valid email address and choose a password (or use a magic link).
- You are responsible for keeping your credentials confidential and for activity under your account.
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You may delete your account at any time from the account settings; this will permanently remove your projects, sessions, briefs, and uploaded files.
4. Acceptable use
You agree not to use the Service to:
- Violate any law or third-party rights, or facilitate such violation.
- Upload content that is unlawful, infringing, defamatory, or that you do not have the right to share (including confidential client material you are not authorised to share with third-party AI providers).
- Attempt to abuse, reverse-engineer, scrape, or overload the Service or its underlying providers, including by generating excessive AI requests.
- Misrepresent the Service or its outputs as your own original analysis without disclosure to clients who would reasonably expect human work.
- Send unsolicited or harassing communications to anyone via interview links.
5. AI-generated output
Briefs and interview questions are produced by a third-party large language model (currently Anthropic Claude via OpenRouter). LLM output can be inaccurate, incomplete, or biased. You are solely responsible for reviewing all AI output before relying on it to make business decisions or to communicate with your clients. We make no warranty that AI output is accurate, complete, fit for any particular purpose, or non-infringing.
We do not claim copyright in AI-generated briefs. As between you and us, ownership of AI-generated output in your account is yours, subject to the rights of the AI provider as described in their terms.
6. Third-party services
The Service depends on third-party providers (e.g. Supabase, OpenRouter, Anthropic, Vercel, Resend, Cloudflare, Upstash) listed in our Privacy Policy. Their terms and availability are outside our control; if a provider becomes unavailable or changes its terms, the Service may be temporarily impaired or modified.
7. Pricing
ReqBrief is offered free of charge during early access. We may introduce paid plans in the future; if we do, we will announce changes in advance and apply them only on a forward-looking basis. Early-access users will be given a fair opportunity to evaluate any paid plan before continued use requires payment.
8. Suspension and termination
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you are violating these Terms, abusing the Service, or causing harm to the Service or to others. You may close your account at any time from the account settings.
Termination does not waive obligations that, by their nature, survive (including liability limits, disclaimers, and accrued obligations).
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. NOTHING IN THESE TERMS EXCLUDES LIABILITY WHERE EXCLUSION IS NOT PERMITTED BY APPLICABLE CONSUMER PROTECTION LAW.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) EUR 50. NOTHING IN THIS CLAUSE LIMITS LIABILITY WHERE LIMITATION IS PROHIBITED BY LAW (E.G. INTENT, GROSS NEGLIGENCE, PERSONAL INJURY, FRAUD).
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from any claim, loss, or liability (including reasonable legal fees) arising from (a) your violation of these Terms, (b) content you upload to the Service, or (c) your use of AI-generated output in your dealings with clients or third parties.
12. Governing law and disputes
These Terms are governed by the laws of [Jurisdiction pending — to be specified once operator is registered], without regard to its conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over disputes arising from these Terms, except where mandatory consumer protection law gives you the right to sue in your country of residence.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
